The year 2019 has been good for Dr. Rajan Lekhraj Mahtani. Despite the numerous challenges and roadblocks, Dr. Rajan Mahtani’s case at the Court of Appeal came out with flying colours. On 31st January 2019, the judge from the Court of Appeal announced that Dr. Rajan Mahtani was majority shareholder as well as legal owner of Zambezi Portland Cement. To arrive at this decision, several evidences, testimonials and other facts were evaluated. The judge Mwinde also shared many of the details to the public and the media to ensure that the case proceeding is transparent and ethical. The first detail was the financial transaction between Finsbury Investments and Zambezi Portland Cement. According to the official and verified evidence, the appellant which is Finsbury Investments paid 250000 US dollars which equals to 1 billion kwachas to the Zambezi Portland Cement. This payment was made in the year 2005 for covering the entire share capital value of the ZPC limited. Furthermore, the original agreement between shareholders was established on 26th Feb 2007 and according to this detailed agreement, Dr. Rajan Mahtani owns 58 percent shares of the Zambezi Portland Cement. Specifically, the details can be found in the page number 663 of volume-Record of Appeal within this agreement report. This agreement also confirmed that Dr. Rajan Mahtani did not owe any further costs associated with the factory and is the primary shareowner of the Zambezi Portland Cement factory.
Several other details were presented to the media and public. It was found that the allegations of fraud and forgery were discarded based on the fact that electronically affixing signatures for business transactions was a common practice at the Zambezi Portland Cement and an accepted one. As such, these allegations were discarded and Dr. Rajan Lekhraj Mahtani was announced as the only majority shareholder of the factory and the lawful legal owner of the factory.
