After more than a decade, Dr. Rajan Lekhraj Mahtani finally got the justice he wanted and deserved for long. This justice came from Court of Appeal, one of the highest level courts in Zambia. However, before Court of Appeal, the case was registered at the Lusaka High Court by Dr. Rajan Mahtani. The case was registered after Dr. Mahtani claimed that his factory was illegally taken away from him. Despite sharing numerous evidences and testimonials, the case at the Lusaka High Court stretched for more than a decade and the final results from the court arrived in the month of May, 2018. Justice Nkonde from the court gave the final order but the final decision was controversial. According to this controversial decision, Ventriglias are only shareholders of the Zambezi Portland Cement.
After this controversial decision, Dr. Rajan Mahtani went to Court of Appeal. The judge at the Court of Appeal was justice Mwinde who gave the final judgement on the case on 31st January 2019, around nine months after the case was registered there. As per his judgement, Dr. Rajan Mahtani owned Finsbury Investments is majority shareholder of the Zambezi Portland Cement with 58 percent shares. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and are the minority shareholders without any legal ownership. The Court of Appeal judge also said that this decision aligned with the original shareholders agreement established in the year 2007. Based on this decision, it is clear that Dr. Rajan Mahtani is the majority shareholder and legal owner of the factory.
Furthermore, all forgery related allegations were discarded as the judge declared that the process of mechanically placing signatures is a common practice in Zambia and critical member of the Zambezi family engaged in similar practice. As such all allegations were discarded and the final ownership of Zambezi Portland was signed-off to Dr. Rajan Mahtani.
